Who these terms are between

"We", "us" and "Hooke Family" mean the operator of hookefamily.com, contactable at admin@hookefamily.com. "You" means the person using the site or placing an order. By using the site or ordering from us you accept these terms; if you do not accept them, please do not order.

Using the website

The site describes the lures we make, explains how to order them, and offers guides on fishing them. You may read it, link to it and quote reasonably from it with attribution. You may not copy the photographs or text for commercial use, present them as your own, or use the site in a way that damages it or interferes with others using it. The content of the guides is general advice offered in good faith; fishing conditions vary and you are responsible for your own safety and for following the fishing regulations that apply where you fish.

How an order is formed

1. You email us describing what you would like and where it should be sent. This is an enquiry, not an order, and it does not commit you.
2. We reply with what is available, the delivery cost and the total. This reply is our offer to sell, and it is open for fourteen days from the date we send it.
3. You accept by paying through the payment link in that reply. A contract exists from the moment your payment is confirmed to us.

Prices and stock on the website are information, not an offer; the price in our reply is the price that applies. If we discover a genuine error in a price after you have paid, we tell you and offer a full refund or the option to proceed at the corrected price.

Payment

Payment is taken through a hosted payment page run by our payment provider, reached through the link in our reply. We do not accept card details by email or by any other route, and we never ask for them. Prices are in US dollars. Any duties, import taxes or fees charged by the destination country are not included and are your responsibility.

Delivery and risk

We dispatch after payment clears and email you when the order has left. Delivery times given in our reply are estimates. The goods are at our risk until they are delivered to the address you gave us; from delivery they are at yours. If you gave us an incorrect or incomplete address, we are not responsible for a resulting failed or delayed delivery, but we will help where we can. Cancellation, returns and refunds

You may cancel before dispatch for a full refund, and return any unused lure within thirty days of receiving it as set out in the shipping and returns policy. Refunds are made as set out in the refund policy. These terms do not reduce any cancellation or return rights you have under the consumer law of the country you live in.

Warranty

Every lure is warranted against manufacturing defects for twelve months from delivery, on the terms in the warranty policy. That warranty is in addition to your statutory rights, not a replacement for them.

Safe use

Our lures carry sharp hooks. They are not toys and are not suitable for children. Keep them in their packaging or a closed box when not in use, keep them away from children and animals, and take care when casting, unhooking fish and handling lures in wind or in a moving boat. Use eye protection where sensible. We are not responsible for injury caused by careless handling of a hook, and we encourage you to read the hooks and handling guide.

Our responsibility to you

If we break these terms, we are responsible for loss you suffer that is a foreseeable result of that breach, up to the amount you paid for the order concerned. We are not responsible for loss that is not foreseeable, for loss of fishing opportunity or of fish, or for business losses. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to exclude.

Trademarks and content

The Hooke Family name, the hook mark, the lure names and the photographs and text on this site belong to us. Using them to suggest that other products are ours, or that we endorse something we do not, is not permitted.

Privacy

How we handle the information in your emails is described in the privacy policy, which forms part of these terms.

General

If any part of these terms is found to be unenforceable, the rest continues to apply. A delay by us in enforcing a term does not mean we have given it up. These terms are the whole agreement between us about your order, and replace anything said on the website that is inconsistent with them. We may update these terms; the version on this page on the date you pay is the one that applies to that order.

Governing law and disputes

These terms are governed by the law of the place where Hooke Family is established, without prejudice to the mandatory consumer protections of the country in which you live, which apply regardless. If something goes wrong, please write to us first; almost everything can be sorted out by email within a couple of days. If it cannot, you may bring a claim in the courts of your own country of residence.
